PROmax3D Terms of Service and 3D Model License

When you purchase and download a 3D model from PROmax3D, you are purchasing a Royalty-Free License to use the digital asset, not the ownership of the asset itself. PROmax3D retains all original copyrights to the 3D models.

1. Allowed Uses (What you CAN do):

Upon purchase, PROmax3D grants you a non-exclusive, worldwide, royalty-free license to use the 3D model in the following ways:

  • Media and Entertainment: You may use the models, and imagery rendered from them, in films, television shows, commercials, animations, and video projects.
  • Real-Time Engines & Games: You may use the models in video games, VR/AR applications, and interactive media, provided the 3D files are compiled and secured within the game engine (such as Unreal Engine or Unity) so that the raw files cannot be extracted by the end-user.
  • Commercial Work: You may use the models for your clients, architectural visualizations, and marketing materials.

2. Prohibited Uses (What you CANNOT do):

To protect our digital assets, the following uses are strictly prohibited:

  • Redistribution or Resale: You may NOT sell, give away, share, or redistribute the raw 3D model files, textures, or rigs in any format. You cannot upload them to other 3D marketplaces (e.g., TurboSquid, CGTrader, Sketchfab).
  • AI Training: You may NOT use PROmax3D models, topologies, textures, or rendered images to train, develop, or feed machine learning or Artificial Intelligence (AI) image/3D generation models.
  • Logos and Trademarks: You may NOT use our 3D models as the primary component of a registered corporate logo, trademark, or service mark.
  • Mass 3D Printing: You may not use the raw model to mass-produce identical physical 3D-printed objects for commercial sale. (You may print up to 5 copies for personal, non-commercial use.) Models marked Editorial Use Only, or depicting real-world brands or protected designs, may not be 3D printed or reproduced in physical form at all.

3. Intellectual Property and Editorial Use

Some models may depict real-world brands, vehicles, or properties. PROmax3D provides the 3D mesh, but we do not grant the rights to use real-world trademarked logos. It is the buyer's responsibility to obtain legal clearance if using branded models in commercial advertising.

4. Editorial Use Only Models

Models marked Editorial Use Only on their product page depict real-world brands, trademarks, or protected designs. These may only be used in editorial contexts: news reporting, documentary, commentary, academic teaching, scholarship, and research.

Editorial Use Only models may NOT be used for advertising, promotion, merchandising, product packaging, logos, physical products for sale, or any other commercial purpose. You may not modify an Editorial Use Only model to remove the branded elements in order to bypass this restriction.

This restriction does not apply if you already hold the rights to the depicted brand — for example, if you are the brand owner or its authorized agency. Confirming that you hold those rights is your responsibility.

5. Sharing Files with Clients and Team Members

If you purchase as part of a company, you may share the files internally with colleagues working on the same project, including on shared or networked storage.

If you are a freelancer or studio working for a client, you may use the model on that client's project and share the files with that client and others working on it, provided they use the files only for that project. If a second client requires the files, a separate license must be purchased for that client.

6. Warranty and Limitation of Liability

All 3D models are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or accuracy of any specification such as scale, measurements, topology counts, or material setup.

To the fullest extent permitted by law, PROmax3D shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of business, revenue, profits, or data, arising from the use of our 3D models. In all cases, total liability shall not exceed the amount you paid for the model in question.

You agree to indemnify and hold PROmax3D harmless from any claim arising from your use of the models, including any claim relating to trademarks or other intellectual property depicted in a model.

7. Refunds and Digital Delivery

All products are digital downloads. Because the files are delivered immediately and cannot be returned, all sales are final once the files have been downloaded. If a file is corrupted, incomplete, or materially different from its product description, contact us and we will repair the file or issue a refund. See our Refund Policy for full details.

8. Changes to This License

PROmax3D may update these terms from time to time. The version in effect at the time of your purchase governs that purchase.

9. Account Termination

Any payment reversal (chargeback) or violation of this license agreement will result in the immediate termination of your license. You will be legally required to cease use of the 3D models and destroy all downloaded copies.
